American Stock Exchange Reports Increase In Short Interest

The American Stock Exchange (Amex) member and non-member organizations today reported short interest of 836,854,201 shares as of the December 15 settlement date, an increase of 32,883,121 from the 803,971,080(adjusted) shares reported in mid-November. The December figure represents trades through December 10, 2003.

Transiciel Removed From Next 150 Index, Cerep Continues To Be Included In Next 150 Index

New composition of Next 150 Index Following the official result of the takeover bid by the French company Cap Gemini (France) (Next 100) for the French company Transiciel (Next 150), Transiciel will be removed from the Next 150 Index effective Tuesday 23 December 2003.

For the past several weeks, my office and the Securities and Exchange Commission (SEC) have been negotiating a settlement with Alliance Capital Management. My office has now reached a settlement that requires Alliance to pay restitution and penalties of $250 million and that also requires Alliance to reduce the fees that it charges by $350 million over the next five years. NYSE Appoints John A. Thain As Chief Executive Officer: Mr. Thain Has Been President And COO Of Goldman Sachs Group, Inc.

The New York Stock Exchange Board of Directors has appointed John A. Thain, president and chief operating officer of Goldman Sachs, as chief executive officer and a member of the Board of Directors of the NYSE, effective Jan. 15, 2004. John S. Reed, who has been interim chairman and chief executive officer of the NYSE since Sept. 30, will resign as interim CEO and remain as interim chairman until a new chairman is appointed.
