Here we are again. I can’t say that I’m surprised that we are back for yet another compliance date extension for Form PF – just three months after our last vote on the exact same issue. We clearly have not been dissuaded from our desire to slowly but surely extinguish duly adopted amendments to Form PF via extension after extension – after extension – despite the command of the Administrative Procedure Act (APA) to engage in transparent notice and comment rulemaking when rescinding rules. And while I’m not surprised we’re back, I am surprised and disappointed by our repeated flouting of the APA. So unsurprisingly, I cannot support yet another extension.

New York State Department of Financial Services Superintendent Adrienne A. Harris today issued new guidance on the use of blockchain analytics tools for banking institutions contemplating or already conducting virtual currency-related activities. As banking institutions experience increasing interest in and exposure to virtual currency activities, blockchain analytics tools have the ability to enhance compliance programs and prevent illegal activities. Today’s announcement builds upon previously released industry guidance to New York State-regulated virtual currency entities.

Finansinspektionen Extends The Risk-Weight Floors For Swedish Mortgages And Commercial Real Estate

FI has decided to extend the risk-weight floors by two years, from 31 December 2025 to 30 December 2027 for Swedish mortgages, and from 30 September 2025 to 29 September 2027 for Swedish commercial real estate.

The second item on today’s agenda is a recommendation that the Commission issue a policy statement[1] (the “Policy Statement”) addressing the presence of a mandatory arbitration provision in the governance documents of a company registering offers and sales of securities and its impact on the acceleration of the effectiveness of the registration statement. In this context, a mandatory arbitration provision requires an investor to arbitrate its claims arising under the federal securities laws with the issuer of the securities.
