FINRA Orders Purshe Kaplan Sterling Investments To Pay $3.4 Million In Restitution To Native American Tribe - Firm Also Fined $750,000 For Failures To Supervise

The Financial Industry Regulatory Authority (FINRA) announced today that Albany, New York-based Purshe Kaplan Sterling Investments (PKS) will pay nearly $3.4 million in restitution to a Native American tribe, after the tribe paid excessive sales charges on purchases of non-traded Real Estate Investment Trusts (REITs) and Business Development Companies (BDCs). In addition to ordering restitution, FINRA fined PKS $750,000 for its failures to supervise the sales of these securities. This settlement resolves charges brought in a February 2016 FINRA complaint against PKS. The charges alleged in the same complaint against the tribe’s PKS registered representative, Gopi Vungarala, are ongoing.

Office Of Financial Research Update Measuring Systemwide Resilience Of Central Counterparties

The U.S. Office of Financial Research today posted a research brief, entitled, “Measuring Systemwide Resilience of Central Counterparties.” This brief proposes a novel way to conduct a U.S. systemwide stress test of central counterparties, or CCPs. The approach takes into account the impacts of losses and defaults at CCPs’ member banks. It would require little extra effort by companies because regulators can use the results of existing stress tests of CCPs.

UK's Financial Conduct Authority: Operation Of The MoU With The Bank Of England For Market Infrastructure - 2016 Performance Statement

Domestically, the Bank co-operates with both the Financial Conduct Authority (FCA) and Payment Systems Regulator (PSR) in relation to supervising market infrastructure and payment systems respectively. The frameworks for co-operation with these authorities are set out in memorandums of understanding which the signatories are required to review annually.

Checkyourfund.eu Goes Live – Results Of Closet Indexing Study Now Searchable Online

A little more than a week ago, Better Finance announced the results of its replication of the ESMA investigation into Closet Indexing. Following up on this announcement, today Better Finance launches www.checkyourfund.eu, allowing stakeholders and individual investors to go through the results of the research and, in some cases, find out whether their investments are potentially falsely active according to the ESMA criteria. The database of the 2332 available funds is easily searchable by simply entering a fund’s ISIN code.
