CFTC: Federal Court Orders Oregon Resident And His Forex Trading Firm To Pay $830,000 In Civil Penalties for Commodity Fraud And Registration Violations

The Commodity Futures Trading Commission today announced that the U.S. District Court for the District of Oregon entered a consent order for permanent injunction, monetary sanctions, and equitable relief against defendants Erik J. Hass and his company Simply Gains, Inc. The order resolves a CFTC action filed against the defendants on June 9, 2020, alleging they fraudulently solicited millions of dollars from unsuspecting customers for trading retail leveraged, margined, or financed foreign currency (forex) and failed to register as required under the Commodity Exchange Act (CEA). Thank you to the Global Interdependence Center for the invitation to speak to you today. My subject is the U.S. dollar's primacy in global finance and the global economy, which some feel is under threat as never before. One headline asserts: "Why the Dollar's Reign Is Near an End." Actually, it turns out this threat isn't so new. That headline was from 2011. It is tempting to write off concerns about the dollar's status that never seem to come to pass, but I don't dismiss them. The role of the United States in the world economy is changing, finance is always changing, and I think it is important for policymakers to regularly consider if and why the dollar's role might change as well. That's what I aim to do in these remarks.

FINRA Fines Morgan Stanley $1.6 Million For Municipal Securities Violations And Related Failures - First FINRA Disciplinary Action For Violation Of Close-Out Requirements Of MSRB Rule G-12(h) And Related Supervisory Failures

FINRA announced today that it has fined Morgan Stanley Smith Barney LLC $1.6 million for the firm’s repeated failures to timely close out failed inter-dealer municipal securities transactions and to take prompt steps to obtain physical possession or control of municipal security positions that are short more than 30 calendar days, and related supervisory failures. This is the first disciplinary action in which FINRA has charged a firm with violating the close-out requirements of Municipal Securities Rulemaking Board (MSRB) Rule G-12(h) and related supervisory failures. FINRA previously sanctioned Morgan Stanley for supervisory failures regarding short positions in municipal securities in 2015.
