Monetary Authority Of Singapore And Commercial Affairs Department To Jointly Investigate All Capital Markets And Financial Advisory Offences

The Monetary Authority of Singapore (MAS) and the Commercial Affairs Department (CAD) of the Singapore Police Force announced today that they will extend the Joint Investigations Arrangement to cover all offences under the Securities and Futures Act (SFA) and Financial Advisers Act (FAA). This will allow for greater efficiency and more effective enforcement of capital markets and financial advisory offences. The expansion in the scope of the Joint Investigations Arrangement will commence from 17 March 2018.

In order to implement China Securities Regulatory Commission’s (“CSRC”) Decision on the Amendment to the Opinions on Reforming, Improving and Strictly Enforcing the Delisting System for Public Company (hereinafter referred to as the Decision), improve the capital market function, upgrade the quality of public companies, and safeguard the rights and interests of investors, the SZSE formulated Implementation Measures on Forced Delisting of Public Companies Due to Major Violation of Law (hereinafter referred to as the Measures), and solicited public opinions thereof.

On November 15, 2016, the Securities and Exchange Commission (“SEC”) approved the National Market Plan Governing the Consolidated Audit Trail (the “CAT NMS Plan” or the “Plan”). The SEC has approved a compliance rule series for each national securities exchange and the Financial Industry Regulatory Authority, Inc. (“FINRA”) (each, a “Participant” in the Plan) that requires the Participant’s members to comply with the CAT NMS Plan requirements and, ultimately, to report information to the CAT.
