ASIC: Review Of How Superannuation Trustees Supported Their Members During COVID-19

During 2020, ASIC took a number of actions to check on the support provided by superannuation trustees to their members during COVID-19. This included reviewing how trustees communicated to members about issues related to COVID-19, and the provision of intra-fund advice.

Concurring Statement Of CFTC Commissioner Dawn D. Stump Regarding Enforcement Action Against Coinbase, Inc.

I concur in the Commission’s findings that Coinbase, Inc., the owner and operator of an online digital asset exchange, violated anti-manipulation provisions of the Commodity Exchange Act (“CEA”) and the CFTC’s rules based on: 1) reporting false, misleading, or inaccurate transaction information; and 2) secondary, principal-agent liability for wash sales by a former “Employee A.” I write separately, though, to ensure the public is not misled to believe that the CFTC regulates exchanges such as Coinbase.

U.S. Department Of Justice: Foreign Nationals Sentenced For Roles In Transnational Cybercrime Enterprise - The Infraud Organization Victimized Millions Of People In All 50 States And Caused More Than $568 Million In Financial Losses

Two foreign nationals — one Russian, the other North Macedonian national — were sentenced today for their role in the Infraud Organization, a transnational cybercrime enterprise engaged in the mass acquisition and sale of fraud-related goods and services, including stolen identities, compromised credit card data, computer malware, and other contraband.

CFTC Orders Coinbase Inc. To Pay $6.5 Million For False, Misleading, Or Inaccurate Reporting And Wash Trading

The Commodity Futures Trading Commission today issued an order filing and settling charges against digital asset exchange operator Coinbase Inc., based in San Francisco, California, for reckless false, misleading, or inaccurate reporting as well as wash trading by a former employee on Coinbase’s GDAX platform.

ISDA Response To UK HM Treasury Cryptoasset And Stable Coin Consultation

ISDA has submitted a response to HM Treasury’s consultation and call for evidence on the UK’s regulatory approach to cryptoassets and stablecoins. ISDA’s response highlights opportunities for the deployment of new technology such as distributed ledger technology (DLT) and smart contracts in the derivatives market. The response also notes the importance of achieving greater legal and regulatory certainty, flagging a number of areas where legal or regulatory barriers to the deployment of new technology in financial markets currently exist. Finally, the paper notes the importance of common, digital standards and the distribution of those standards across the industry, and describes a number of important ISDA initiatives in this area, such as the ISDA Clause Library and Common Domain Model.

EBA Acknowledges Adoption By The European Commission Of Standards On Institutions’ Public Disclosures

The European Banking Authority (EBA) acknowledged today the adoption by the European Commission of the Implementing Act laying down implementing technical standards (ITS) on institutions Pillar 3 disclosures. The Implementing Act, which is based on the final draft ITS on institutions’ public disclosures submitted by the EBA in June 2020, was adopted by the Commission on 15 March 2021 but its publication in the EU Official Journal is still pending. The disclosure ITS will apply from 30 June 2021.
