Pursuant to Section 5c(c)(1) of the Commodity Exchange Act, as amended (“Act”), and Section 40.2(a) of the regulations promulgated by the Commodity Futures Trading Commission (the “Commission”) under the Act (the “Regulations”), North American Derivatives Exchange, Inc. (“Nadex”, the “Exchange”), Nadex self-certified the terms and conditions for its Consumer Price Index Food at Home Event Contracts that the Exchange previously listed. These contracts will be listed on or after trade date May 15, 2023.

Today, the Commission resolved four long-pending adjudication matters. The Commission’s order in each of the matters imposes a penny stock bar on the respondent.  Because I do not agree that the records in these matters establish that imposing a complete and permanent penny stock bar on each respondent is in the public interest, I dissented from the imposition of the bars.  I write to explain why.
