Statement Of Dissent By CFTC Commissioner Jill E. Sommers And CFTC Commissioner Scott D. O’Malia - Fiscal Year 2011 Annual Performance Report

We respectfully dissent from the fiscal year 2011 Annual Performance Report (the “Report”). While we don’t disagree with the stated performance criteria goals, we must protest the fact that funds and priorities have been withdrawn from critical futures market oversight and rule enforcement reviews to focus on the Dodd-Frank rules. This document is filled with statements that make it clear that Dodd-Frank rulemaking is a priority and will be pursued at the expense of other critical goals and priorities. We hope the Commission will work to rebalance its funding and focus from those areas that have exceeded expectations and goals to those that are critically underfunded, in particular the Division of Market Oversight and the Office of Data and Technology.

I. Introduction
Thank you, Paul, for that kind introduction. Good morning to you and everyone in the audience both here in New York and those participating through groupcast and webcast. I am very excited to be here today to discuss the Division of Investment Management’s various priorities, and most importantly, listen to the views of my three distinguished predecessors in the panel immediately following my remarks. Each one of my predecessors has done an extraordinary job leading the Division at different points in time and I hope to learn from and emulate their successes.

The US cash equities market has been losing the battle for order flow for three years in a row, forcing institutional equity brokers in 2011 to see their third annual decline in commission. According to new research from TABB Group, execution-only commissions will fall more precipitously in 2012 as the buy side continues to squeeze every dollar out of their constrained wallets.

ESMA: Publication Of The Responses Received To The Consultation On Short Selling And CDS

In November 2011 the Council and the Parliament voted on a Regulation on short selling and certain aspects of credit default swaps. This is about to be published and should be applicable from 1 November 2012. According to the Regulation ESMA has to submit its technical standards to the Commission by 31 March 2012.

The product, hosted in the NYSE Technologies U.S. Liquidity Center in Mahwah, is designed to offer fully automated surveillance and compliance capabilities across asset classes. Trade Exception Radar provides real-time performance with a complete audit trail. It helps firms collect and analyze trading patterns, detect and identify potential trading issues, and monitor trading patterns in real-time.
