SEC: Staff Guidance On SRO Rule Filings Relating To Fees

The Division has prepared this guidance to assist the national securities exchanges and FINRA (hereafter, “SROs”) in preparing Fee Filings that meet their burden to demonstrate that proposed fees are consistent with the requirements of the Securities Exchange Act of 1934 (“Exchange Act”), and rules thereunder. The Exchange Act provides that a proposed rule change may not take effect unless it is approved by the Commission pursuant to Exchange Act Section 19(b)(2), or it becomes immediately effective upon filing pursuant to Exchange Act Section 19(b)(3)(A). Rule 19b-4(f) under the Exchange Act specifies the types of proposed rule changes that may become immediately effective upon filing with the Commission, and includes those properly designated by the SROs as “establishing or changing a due, fee, or other charge imposed by the self-regulatory organization.” Whether filed for Commission approval or immediate effectiveness, all proposed rule changes, including proposed fee changes, are required to be consistent with the Exchange Act.

SIFMA: SECURE Act Of 2019 Deserves Strong Bipartisan Support

SIFMA today issued the following statement from President and CEO Kenneth E. Bentsen, Jr. on H.R. 1994, the Setting Every Community Up for Retirement Enhancement (SECURE) Act of 2019, which is expected to be voted on this week:
“The American retirement system has helped millions of Americans prepare for a secure retirement. The SECURE Act will help even more Americans realize this benefit. This legislation takes important steps toward enhancing the private retirement system and increasing retirement savings by encouraging small businesses to offer retirement savings plans and individuals to utilize the options that are available to enjoy retirement security. These commonsense provisions deserve strong bipartisan support.”

ISDA CDM Deployed To Help Deliver UK Digital Regulatory Reporting Pilot

ISDA has today announced the deployment of the ISDA Common Domain Model (ISDA CDM 2.0) to support the UK Financial Conduct Authority, the Bank of England and participating financial institutions in testing phase two of the digital regulatory reporting (DRR) pilot for derivatives.
