  • ISDA - US Basel III Endgame: Trading And Capital Markets Impact

    In July 2023, the Board of Governors of the Federal Reserve System, the Office of the Comptroller of the Currency and the Federal Deposit Insurance Corporation proposed capital rules known as the US Basel III ‘endgame’ based on the global minimum regulatory capital standards developed by the Basel Committee on Banking Supervision (BCBS). If finalized as currently drafted, the US Basel III proposal will have a significant negative impact on trading activity and the liquidity and vibrancy of the US capital markets, with adverse effects on derivatives end users, investors, businesses and consumers.

    Today, the Commission is considering amendments to Regulation S-P that will require covered firms to notify their customers of data breaches. I support these amendments because, through making critical updates to a rule first adopted in 2000, these amendments will help protect the privacy of customers’ financial data.

    Central clearing of derivatives has become a cornerstone of regulatory efforts to reduce risk and make markets more resilient. But to work for credit derivatives, there had to be a single, standardized mechanism for determining whether a credit event had occurred. That was the genesis of the Credit Derivatives Determinations Committees 15 years ago, and they’ve ensured this market has been able to function safely and efficiently ever since. Of course, that’s not to say the process can’t be improved, which is why we launched a public consultation earlier this week on possible changes that could be made to the structure and governance of the committees.

  • Vojtěch Belling Reappointed Vice Chair Of ESMA

    The Board of Supervisors of the European Securities and Markets Authority (ESMA) has reappointed Vojtěch Belling as its Vice Chair. Mr Belling, who is the Executive Director of the Financial Market Regulation and International Cooperation Department of the Czech National Bank (CNB), will serve a further two-and-a-half-year term effective immediately.
