Good morning. I’m pleased to join you today.
My invitation to speak to you today was a broad one. I was given licence to choose any topic or topics to focus on. And flexibility was preserved by the designation of the title for this session: ‘ASIC’s Vision for a Fair, Strong and Efficient Financial System for all Australians’. A fair, strong and efficient financial system is of course ASIC’s vision statement and underpins everything that we do. So, I could have presented on a range of topics.

CFTC Charges Unregistered Commodity Pool Operator, Two California Men With $2.3 Million Fraud

The U.S. Commodity Futures Trading Commission announced today that it filed a civil enforcement action in the U.S. District Court for the Central District of California charging Main & Prospect Capital, LLC and two California men—the firm’s president, Daniel Adam Hewko (Adam Hewko), and his father, Daniel Hewko—with fraud. The complaint also alleges that the defendants violated CFTC registration requirements and various commodity pool operator requirements.

Canadian Securities Exchange Announces Partnership With Jamaica Stock Exchange ̶ Signed MOU To Foster Co-Operation Between Exchanges

The Canadian Securities Exchange (“CSE” or “the Exchange”) has announced that it has signed a Memorandum of Understanding (“MOU”) with the Jamaica Stock Exchange (“JSE”). The MOU facilitates co-operation and sharing of information between the two exchanges in order to enhance the respective markets for the benefit of all participants.

CFTC Swaps Report Update

The CFTC Swaps Report provides a detailed weekly snapshot of the gross notional outstanding as of the penultimate Friday prior to the CFTC Swaps Report’s Wednesday publication date, as well as a detailed weekly total of the transaction volume (on both a ticket volume and dollar volume basis) ending that same penultimate Friday, in two asset classes (interest rate swaps, credit default swaps).

Superintendent of Financial Services Linda A. Lacewell today announced that Ray Dorado has joined her executive team at the Department of Financial Services (DFS) as Senior Deputy Superintendent for the Banking Division. At DFS, Mr. Dorado will be responsible for assisting the Executive Deputy Superintendent of Banking Shirin Emami in the supervisory, regulatory, and legislative issues related to the operations and activities of all units of the Banking Division.

Marie-Louise Huth Named Chief Counsel In SEC Division Of Economic And Risk Analysis

The Securities and Exchange Commission today named Marie-Louise (Malou) Huth as Chief Counsel for the Division of Economic and Risk Analysis (DERA). Ms. Huth will lead DERA’s Office of the Chief Counsel, which provides guidance to the Chief Economist and other staff regarding legal issues implicated by the Division’s broad mandate. As Chief Counsel, Ms. Huth will be responsible for collaborating with staff from across the Commission on matters related to the integration of the DERA’s economic analyses into Commission rulemakings and other Commission actions. Ms. Huth will also provide guidance on a variety of mission-related legal and policy matters involving risk assessment, data analytics, and structured disclosure.

Trade Deal Hopes Unfulfilled, Optimism That Tariffs Might Be Selectively Reduced Lifted Commodity Prices Mid-Week Before Falling Flat, William May, Senior Economist, IHS Markit

Commodity prices, as measured by the IHS Markit Materials Price Index (MPI), fell 1.2% last week, their seventh straight weekly decline. Prospects for a “phase-one” US-China trade agreement, with a promise of selected tariff reductions, were enough to rally equity prices, lift bond yields, and even lift material prices through mid-week. However, strength in commodity markets dissipated by week’s end on President Trump’s statement denying reports that a trade deal had been reached.
