  • ISDA And FIA Respond To EC On CSDR Review

    On May 31, 2022, ISDA and FIA submitted a joint response to the European Commission’s (EC) proposal to review the Central Securities Depositories Regulation (CSDR), with a focus on reforms of the mandatory buy-in regime (MBI) under Article 7 of the CSDR. In the response, ISDA and FIA’s members highlighted the application of the MBI regime to margin transfers and the physical settlement of derivatives transactions as an area of concern, as it could lead to uncertainty and unintended consequences, as well as the disruption of existing contractual default provisions. ISDA and FIA believe it is crucial for the EC to clarify that margin transfers and physically settled derivatives are not in scope of the MBI regime. The associations also recommend targeted amendments to the level 1 carveouts from the MBI regime, with a view to enhancing legal clarity and avoiding unnecessary costs for market participants.

  • CFTC Charges Florida Man With Fraudulent Solicitation Of Over $800,000 And Misappropriation In Futures Scheme - Federal Court Ordered Cox To Pay Over $900,000 In Restitution And Penalties In Prior CFTC Fraud Action

    The Commodity Futures Trading Commission today announced that it filed a civil enforcement action in the Southern District of Florida against Rico Cox of Fort Lauderdale, Florida. The complaint alleges that, for a second time, Cox fraudulently solicited and accepted funds, this time at least $842,900 that was intended for commodity futures trading. Cox has never been registered with the CFTC.

    Trading volume on swap execution facilities reached $887.4 billion in average notional value per day during April 2022. This was down 21.7% from the previous month but up 18.8% from the same month of the previous year. Trading was down in every sector except for FRA trading.
