SEC Charges Citadel Securities For Violating Order Marking Requirements Of Short Sale Regulations

The Securities and Exchange Commission today announced settled charges against broker-dealer Citadel Securities LLC for violating a provision of Regulation SHO, the regulatory framework designed to address abusive short selling practices, which requires broker-dealers to mark sale orders as long, short, or short exempt. These records are routinely used by regulators in policing prohibited short selling activity. To settle the SEC’s charges, Miami-based Citadel Securities agreed to pay a $7 million penalty.

Deutsche Börse Announces Final Tender Result For Takeover Of SimCorp

Deutsche Börse has today announced the final tender result for its public takeover of SimCorp. Including open market purchases, Deutsche Börse now holds approximately 94 per cent of all SimCorp shares (excluding SimCorp’s treasury shares). The offer is expected to be settled and closed on 29 September 2023.

Goldman To Pay SEC $6 Million In Penalties For Providing Deficient Blue Sheet Data

The Securities and Exchange Commission today announced settled charges against Goldman Sachs & Co. LLC for failing to provide complete and accurate securities trading information, known as blue sheet data, to the SEC. Goldman agreed to pay a $6 million penalty to resolve the SEC's charges.

Introduction
As I was in 2018, I am excited to speak to you at the National Bureau of Economic Research (NBER) artificial intelligence (AI) conference, in a city that is a world-class center of AI research and business start-ups, to discuss AI and its prospective effects on productivity and the labor market. Outside of those of us who have spent many years researching the economics of innovation, it seems that AI is having a moment. The surge in excitement and trepidation about AI is palpable. Google searches for "AI" have tripled worldwide since 2022, fueled by the buzz about ChatGPT. Of course, this group saw it coming as early as 2017, when the first NBER AI conference was held here in Toronto, and many of you saw it coming much earlier than that.

I respectfully dissent from the Order Prohibiting Listing for Trading of Certified Derivatives Contracts with Respect to Political Control of the U.S. Senate and House of Representatives (the “Order”).  I cannot support the Commission taking this trip “through the looking glass” in order to cover up the fact that for over 13 years, it has failed to follow the process that Congress specifically authorized for situations like this:  A notice-and-comment rulemaking.

Statement Of CFTC Chairman Rostin Behnam Regarding CFTC Order To Prohibit Kalshi Political Control Derivatives Contracts

Today’s Order prohibits listing or otherwise making available for clearing or trading certain Congressional Control Contracts on or through KalshiEx LLC (“Kalshi”) based on findings that such political event contracts involve both gaming and activity that is unlawful under State law, and are contrary to the public interest. The Commodity Exchange Act (CEA) enumerates certain categories of commodities for which derivatives may be contrary to the public interest if listed on an exchange.  These include contracts that involve gaming or activity that violates State or Federal Law.  Kalshi’s Congressional control contracts fall into both of these categories.  Betting or wagering on elections, as proposed by Kalshi, meets the definition of gaming.  And in many states, betting or wagering on elections is prohibited by statute or common law.  The analysis conducted, determinations reached, and process followed resulting in the Commission’s Order are squarely within our duty and discretion.
