NYSE Euronext Announces Trading Volumes For January 2013 - Global Derivatives ADV Up 27% Y-o-Y Driven By Strong Fixed Income Trading, Up 64% - U.S. Equity Options ADV Up 10% Y-o-Y; Record Market Share Of 29% - U.S. And European Cash ADV Declined Y-o-Y But Rebounded From December 2012 Levels

NYSE Euronext (NYX) today announced trading volumes for its global derivatives and cash equities exchanges for January 2013[1]. Global derivatives average daily volume (“ADV”) of 9.5 million contracts in January 2013 increased 26.9% compared to January 2012, and increased 27.5% from December 2012 driven principally by stronger fixed income derivatives ADV which increased 64% year-over-year and 91% month-over-month. U.S. Equity options volumes rebounded in January 2013 with an increase of 9.9% compared to January 2012 and an increased of 17.9% from December 2012 levels. U.S. Equity options combined market share set a new record high of 29.4% in January 2013. Trading volumes in European and U.S. cash equities declined year-over-year, but improved from December 2012 levels.

Squawker®, the negotiation venue for pan-European, sell-side block trading today confirmed that ULLINK, provider of low-latency connectivity and trading solutions for the global financial community, has completed connectivity to the block trading negotiation venue from the ULLINK global trading network. This certification includes the FIX integration of ULLINK’s trading front-end called UL TRADER. The direct FIX connectivity will enable ULLINK’s sell-side community to route Orders, IOIs and Advertised Trades to Squawker and access the new venue’s block liquidity from go-live.

ASX Commits To Code Of Practice For Cash Equities Clearing And Settlement

ASX welcomes today’s announcement by the Deputy Prime Minister and Treasurer, the Hon Wayne Swan, which retains the current market structure for clearing and settlement of cash equities, and requests ASX to put in place a Code of Practice for Clearing and Settlement of Cash Equities in Australia.

CFTC Sanctions Gelber Group, LLC $750,000 For Trading Abuses On Two Exchanges - Gelber Falsely Reported Orders That Caused Non-Bona Fide Prices To Be Included In The Indicative Opening Price In The Chicago Mercantile Exchange’s NASDAQ E-Mini 100 Futures Contract And Engaged In Wash Sales- Separately, Former Gelber Trading Manager Martin A. Lorenzen Ordered To Pay $200,000 For Engaging In Illegal Wash Sales

The U.S. Commodity Futures Trading Commission (CFTC) today announced the filing and simultaneous settlement of charges against Gelber Group, LLC (Gelber) of Chicago, Ill., for reporting orders during pre-opening trading sessions that Gelber had no intention of executing. The CFTC also settled charges against both Gelber and former Gelber trading manager Martin A. Lorenzen for engaging in wash sales. The CFTC Orders require Gelber and Lorenzen to pay a civil monetary penalty of $750,000 and $200,000, respectively, and order the Respondents to cease and desist from violating the Commodity Exchange Act (CEA) and CFTC regulation 1.38, as charged.

CFTC Commissioner Jill E. Sommers’ Concurrence In The Matter Of Gelber Group LLC And Martin A. Lorenzen

I applaud the Division of Enforcement (“DOE”) for bringing this case against Gelber and its former employee Lorenzen and I concur with the recommendation put forth by the DOE. However, given that there were other individuals engaged in the conduct at issue, I must state my firm belief that taking aggressive action against allindividuals engaged in violations of the Act and Regulations is the best deterrent to breaches of our Act and Regulations. As Commissioner Chilton explains in his dissent, these are very serious violations of federal law and should be treated as such.

CFTC Commissioner Bart Chilton’s Concurring In part And Dissenting In Part To The Settlement In The Matter Of Martin A. Lorenzen, Respondent

While I concur in the terms of the settlement in this matter with regard to the findings of violations and the non-monetary components of the settlement order, I respectfully dissent as to the amount of the civil monetary penalty (CMP). A CMP of $200,000 is wholly inadequate as a penalty for the wash sale activity that Mr. Martin A. Lorenzen directed and oversaw while acting as a manager at the Gelber Group LLC.
