ASIC: ASX Pays $1,050,000 Penalty For Order Information Transparency Failure

ASX Limited has paid a penalty of $1,050,000 following an ASIC investigation into its compliance with the Market Integrity Rules. This is the first time ASIC has issued an infringement notice to a market operator.

The former Chief Executive Officer (CEO) of Envysion Wealth Management Pte Ltd (Envysion), currently known as Hui Xun Asset Management Pte Ltd, Ms Shim Wai Han, and its former directors (former Chief Investment Officer, Mr Doo Chun Ki and former Chief Operating Officer and Chief Compliance Officer, Mr Tan Kay Siong) were charged in court today for offences under the Securities and Futures (Licencing and Conduct of Business) Regulations (SF(LCB)R) and the Securities and Futures Act (SFA). Envysion was a holder of a capital markets services licence for fund management and manager of the Envysion Global Investments VCC which established the Envysion Commodity Strategy Fund (Fund).

CalPERS Applauds Increased Transparency In SEC Climate Disclosure Rule, But Notes More Needs To Be Done

Marcie Frost, chief executive officer for the California Public Employees’ Retirement System (CalPERS) issued the following statement Wednesday in response to the Securities and Exchange Commission’s Climate Disclosure Rule (PDF). The rule, for which CalPERS provided input and support in 2021 (PDF) and 2022 (PDF), will standardize the information that publicly traded companies disclose about their material climate-related risks.

Thank you, Mr. Chair. On balance, the Rule 605 amendments we are voting on today are positive. Over the past quarter-century since Rule 605 first mandated the disclosure of certain order-related information, our markets have changed dramatically. Decimalization, the adoption and implementation of Regulation NMS, the increased speed at which orders are communicated and transactions are executed: All of these have combined to refashion the market in ways very different from the market of Y2K.
