Updated Statement On The Effect Of The Court Of Appeals Decision On The Conflict Minerals Rule - SEC Division Of Corporation Finance

On August 18, 2015, the U.S. Court of Appeals for the District of Columbia Circuit reaffirmed its prior holding that Section 13(p)(1) of the Securities Exchange Act and Rule 13p-1 “violate the First Amendment to the extent the statute and rule require regulated entities to report to the Commission and to state on their website that any of their products have ‘not been found to be “DRC conflict free.”’”  On April 3, 2017, the U.S. District Court for the District of Columbia entered final judgment in the case and remanded to the Commission.

EBA ssues Amended Technical Standards On Supervisory Reporting For EU Institutions

The European Banking Authority (EBA) published today its final draft Implementing Technical Standards (ITS) amending the European Commission's Implementing Regulation (EU) No 680/2014 on supervisory reporting  so as to keep reporting requirements in line with changes in the regulatory framework and with the evolving needs for Supervisory Authorities' risk assessments. The updated ITS include (i) new information on sovereign exposures; (ii) changes to operational risk; (iii) changes to additional monitoring metrics for liquidity and (iv) Q&A- based changes and other minor amendments. These changes form part of the EBA reporting framework version 2.7, which will be applicable for submissions of data as of March 2018.

Legal basis

The EBA is required to develop ITS specifying supervisory reporting in the areas of own funds, financial information, losses stemming from lending collateralised by immovable property, large exposures, leverage ratio, liquidity ratios, asset encumbrance, additional liquidity monitoring metrics and supervisory benchmarking. These ITS are adopted by the EU Commission in the form of Implementing Regulations. The present publication comes as an update to the Regulation (EU) No 680/2014.

ESAs Publish Official Translations Of Final Guidelines On Risk-Based Supervision Under The Fourth Anti Money Laundering (AML) Directive

The Joint Committee of the three European Supervisory Authorities (EBA, EIOPA and ESMA - ESAs) published today 22 language versions of the final Guidelines on the characteristics of a risk-based approach to anti-money laundering and terrorist financing supervision under Directive (EU) 2015/849 on preventing the use of the financial system for money laundering or terrorist financing (Fourth Anti Money Laundering (AML) Directive).
