US Department Of Justice: New York Broker-Dealer Pleads Guilty To Violating U.S. Antitrust Laws By Rigging Bids For Financial Instruments - First Charge Filed In Ongoing Pre-Release ADRs Investigation

Banca IMI Securities Corp. (Banca IMI), a New York broker-dealer, pleaded guilty to an antitrust charge and was sentenced to pay a criminal fine in excess of $2 million for its involvement in a bid-rigging conspiracy for certain financial instruments, the Department of Justice announced today.

CFTC Charges CEO Of Managed Fund With Misappropriation, Fraud, And Making False Statements To NFA

The Commodity Futures Trading Commission (CFTC) announced today that it filed a civil enforcement action (Complaint) in the U.S. District Court for the Southern District of New York that charges defendant Fabio Bretas de Freitas with fraud and misappropriation in connection with commodity futures trading. Bretas de Freitas conducted his scheme through the registered commodity pool operator and commodity trading advisor Phy Capital Investments LLC, f/k/a Phynance Capital Management LLC (PCI) (Collectively defendants). The Complaint also charges Bretas de Freitas with making false statements to the National Futures Association.

Thank you to the Banque de France for giving me the opportunity to speak at this conference, both as Chair of the Bank for International Settlements’ Committee on Payments and Market Infrastructures (CPMI) and as Member of the Executive Board of the European Central Bank. Since my remarks dwell on cyber resilience for financial market infrastructures, I would like to take this opportunity to pay tribute to Alberto Giovannini, who passed away two weeks ago. Alberto combined theoretical insight with a deep understanding of how financial markets work. His 2001 and 2003 reports on Cross-border Clearing and Settlement Arrangements in the EU have shaped the discussion on European post-market activities. He would have encouraged us to start our discussion from first principles and recognise cyber resilience for what it is: a global public good.
