MIAX Options: Certain Give-Up & CMTA Transactions Subject To ORF Effective May 1, 2015

Beginning May 1, 2015, trades executed by a MIAX member firm on the MIAX Options Exchange or on an away exchange that are Given-Up to, or CMTA transferred to, a non-member firm on the MIAX Options Exchange or on an away exchange will be subject to MIAX’s Options Regulatory Fee (ORF). This will allow MIAX to collect the ORF from all transactions that require regulatory oversight and is consistent with current industry practices. Please note that there is no change to the amount of the MIAX Options Regulatory Fee.

FINRA, FINRA Foundation And First Nations Issue Joint Investor Alert, New Money Coming Into Indian Country: Plan For The Long Term

The Financial Industry Regulatory Authority (FINRA), the FINRA Investor Education Foundation and First Nations Development Institute (First Nations) have issued a joint Investor Alert called New Money Coming Into Indian Country: Plan for the Long Term. Over the past five years, Indian Country lawsuit settlements totaling more than $3 billion have been reached. This Alert provides recipients and potential recipients of settlement and other new money with helpful tips to help them confidently manage their finances, as well as avoid financial fraud.

Concurring Statement Of CFTC Commissioner Bowen Regarding Proposed Rulemaking On Trade Options

Today, we are approving a proposed rule that would implement changes to the Commission’s Trade Option exemption to reduce the burden on commercial entities seeking to hedge risks associated with their physical businesses. I support these changes. However, based upon comments the Commission has received and meetings that I have had with members of the public, I believe the Commission should consider additional clarifications to better ensure legal certainty for the manufacturing, energy and agricultural industries’ ability to address their commercial risks.

US Federal Agencies Issue Final Rule On Minimum Requirements For Appraisal Management Companies

Six federal financial regulatory agencies today issued a final rule that implements minimum requirements for state registration and supervision of appraisal management companies (AMCs). An AMC is an entity that provides appraisal management services to lenders or underwriters or other principals in the secondary mortgage markets. These appraisal management services include contracting with licensed and certified appraisers to perform appraisal assignments.

Statement Of CFTC Commissioner J. Christopher Giancarlo Regarding Trade Options Rule

I support the Commission’s proposed amendments to the interim final trade options rule. These are common sense reforms that will alleviate certain recordkeeping and reporting burdens that § 32.3 currently imposes on end-users that use trade options to manage commercial risk. The deletion of the reference in § 32.3(c)(2) to part 151 position limits is also appropriate in light of the fact that part 151 was vacated by the court in Int’l Swaps & Derivatives Ass’n v. U.S. Commodity Futures Trading Comm’n, 887 F. Supp. 2d 259 (D.D.C. 2012).
