SEC Obtains Receiver Over Florida Investment Adviser Charged With Fraud

The Securities and Exchange Commission today announced that it has obtained the appointment of a receiver over Florida-based investment adviser TCA Fund Management Group Corp., its affiliate TCA Global Credit Fund GP Ltd. (TCA-GP), and several funds managed by TCA to protect investors from a fraudulent scheme allegedly conducted by TCA.

The Federal Reserve Board on Tuesday announced additional information regarding borrower and collateral eligibility criteria for the Term Asset-Backed Securities Loan Facility (TALF). The facility was announced on March 23 as part of an initiative to support the flow of credit to U.S. consumers and businesses. To help ensure that U.S. consumers and businesses remain able to access credit at affordable terms, TALF initially will make up to $100 billion of loans available.

EBA Publishes Its Inquiry Into Dividend Arbitrage Trading Schemes (“Cum-Ex/Cum-Cum”), And Announces A 10-Point Action Plan To Enhance The Future Regulatory Framework

• The EBA’s inquiry showed that national authorities do not share the same understanding of dividend arbitrage trading schemes, due to differences in Member States’ domestic tax law;
• The inquiry concluded that facilitating, or handling proceeds from tax crimes undermines the integrity of the EU’s financial system and, therefore, sets out a number expectations of credit institutions and national authorities under the current regulatory framework;
• The EBA decided on a 10-point action plan for 2020/21 to enhance the future framework of prudential and anti-money laundering requirements covering such schemes.

EBA Updates Data On Deposit Guarantee Schemes Across The EU

The European Banking Authority (EBA) published today 2019 data relating to two key concepts in the Deposit Guarantee Schemes Directive (DGSD): available financial means, and covered deposits. The EBA publishes this data on a yearly basis to enhance the transparency and public accountability of deposit guarantee schemes (DGSs) across the EU to the benefit of depositors, markets, policymakers, DGSs and Members States.

ACER Provides Its First Opinion On A Bidirectional Gas Capacity Decision

The European Union Agency for the Cooperation of Energy Regulators (ACER) publishes today its Opinion on the elements of the Decision to grant an exemption from the obligation to enable permanent physical bi-directional capacity at the "Deutschneudorf EUGAL "cross-border interconnection point (IP), between Germany and the Czech Republic. The Decision was taken by Bundesnetzagentur, Germany’s National Regulatory Authority and grants the exemption for a period of four years.
