ASIC Update On Compensation For Financial Advice Related Misconduct

Six of Australia's largest banking and financial services institutions have paid or offered a total of $1.05 billion in compensation, as at 30 June 2020, to customers who suffered loss or detriment because of fees for no service (FFNS) misconduct or non-compliant advice.

The CSRC issued Guidelines for Publicly-offered Infrastructure Securities Investment Funds (Trial) on August 7, effective from the date of promulgation. Publicly-offered REITs are defined as an exchange-listed closed-end funds which invest more than 80% of its assets in infrastructure-focused asset-backed securities and distribute to its investors no less than 90% of the revenue generated by the fund manager’s management and operation of the infrastructure. Range of infrastructure is wide in the pilot program which contains utilities, tollway and warehousing and logistics facilities and so on.

Today, the Commission proposed amendments to the national market system (“NMS”) plan governing the consolidated audit trail (“CAT NMS Plan”). The proposed amendments are designed to enhance data security related to the ongoing development and operations of the consolidated audit trail ("CAT"). In 2016, the Commission approved the CAT NMS Plan prepared by FINRA and the national securities exchanges (collectively, the “SROs”) which included various security requirements.[1] Today’s proposal would take additional steps to reduce cybersecurity risks and is the latest in a series of Commission actions to move the development of the CAT forward and enhance the CAT’s data security standards and posture, including by reducing the scope of sensitive data collected.

Today the Securities and Exchange Commission proposed amendments to the national market system plan governing the consolidated audit trail (CAT). Because the proposed amendments are designed to enhance the security of the consolidated audit trail, I supported the proposal. I would have preferred the bolder step of confronting the CAT’s real and serious liberty implications.

Nadex Temporarily Amends Binary Contracts Strike Width

Pursuant to Section 5c(c)(1) of the Commodity Exchange Act, as amended (“Act”), and Section 40.6(d) of the regulations promulgated by the Commodity Futures Trading Commission (the “Commission”) under the Act (the “Regulations”), North American Derivatives Exchange, Inc. (“Nadex”, the “Exchange”) hereby provides notice that due to increased volatility in the underlying markets upon which the Nadex contracts are based, Nadex made changes to the strike widths of various contracts during the week of August 17, 2020 as indicated in the Weekly Notice.

US Federal Agencies Issue Statement Providing Additional Information For Certain Bank Secrecy Act Due Diligence Requirements

The Federal Reserve Board, the Federal Deposit Insurance Corporation, the Financial Crimes Enforcement Network, the National Credit Union Administration, and the Office of the Comptroller of the Currency today issued a joint statement clarifying that Bank Secrecy Act (BSA) due diligence requirements for customers who may be considered "politically exposed persons" (PEPs) should be commensurate with the risks posed by the PEP relationship.
