Statement On Proposal To Shorten The Settlement Cycle, SEC Commissioner Hester M. Peirce, Feb. 9, 2022
Date 09/02/2022
For several weeks starting in early 2021, the U.S. financial markets saw an unexpected surge in interest from retail investors in a small number of stocks that some argued had been neglected and undervalued by the market. Fueled by social media, enthusiasm for these stocks spread like wildfire. As prices rose, so too did retail interest in the markets. Terms like “FOMO,” “diamond hands,” “to the moon,” “tendies,” and “stonks” found their way into the popular lexicon.

Statement On Proposal To Shorten The Standard Settlement Cycle, SEC Commissioner Allison Herren Lee, Feb. 9, 2022
Date 09/02/2022
Today’s proposal represents a relatively simple calculus: reducing the time it takes for securities transactions to settle, generally reduces risks - credit risks, market risks, liquidity risks, and importantly, potential systemic risk. That risk reduction, even when balanced against the costs to achieve it, should ultimately result in cost savings throughout the system as less margin is required by clearing agencies.

Statement On Cybersecurity Risk Management For Investment Advisers, Registered Investment Companies, And Business Development Companies, SEC Commissioner Allison Herren Lee, Feb. 9, 2022
Date 09/02/2022
Cyber-attacks have increased at an alarming rate in recent years in terms of size, frequency and sophistication. The Equifax breach in 2017 could cost the company as much as $700 million, and affected over 145 million consumers. In 2019, SolarWinds experienced a major cyber breach that impacted nearly 18,000 of its customers, prompting the U.S. Department of Homeland Security to issue an emergency directive to all federal agencies. The acceleration has continued unabated into 2021 with the Colonial Pipeline Company becoming the victim of an attack that heavily disrupted the flow of gas to the East Coast for days, and one of the largest U.S. insurance companies reportedly paying $40 million to hackers after it suffered a ransomware attack. In fact by some measures, we’ve seen a more than a 68% increase since 2020 in the overall number of data compromises, and a concomitant rise in the sophistication of these bad actors.

Statement On Proposed Rules For Private Fund Advisers, SEC Commissioner Allison Herren Lee, Feb. 9, 2022
Date 09/02/2022
Transparency, protection against conflicts of interest, and accountability – these are cornerstones of investor protection in all markets and for all investors. I am pleased to support today’s proposal which seeks to achieve these goals in the private fund space in a thoughtful and well-informed manner. With over 5,000 registered private fund advisers managing over $18 trillion in private fund assets, this growing segment of the market has a significant impact on investors, capital markets and our economy. As noted in the release, the staff has a decade of oversight under its belt, and now brings that depth of experience and expertise to bear in proposing a number of important reforms.
