EBA Publishes Peer Review On Authorisation Under The Payment Services Directive

The European Banking Authority (EBA) today published its peer review on authorisation of payment institutions and e-money institutions under the revised Payment Services Directive (PSD2). The review generally found increased transparency and consistency of the information required in the authorisation process. However, it also identified significant divergences in competent authorities’ assessment and the degree of scrutiny of applications. The review, therefore, sets out a series of measures to address such divergencies, to level out the supervisory playing field and to mitigate against ‘forum shopping’.

ACER Approves The New Automatic Maximum Price Limit Adjustment Mechanism For The European Electricity Spot Markets

Europe’s spot electricity markets have an automatic maximum price limit adjustment mechanism in case of extraordinary high prices. ACER has approved changes in the methodologies for automatically increasing the maximum price limit in case of price spikes for the day-ahead and intraday markets. The timely adjustment of those price limits is needed to ensure security of supply this winter through optimal short-term dispatch of generation, efficient use of interconnections and to encourage demand response.

BaFin Investigates F.W International (Finance Wise International)

F.W International (Finance Wise International) establishes unsolicited contact with German customers of the trading platform hoxglobal.com, operated by Trading Global (Hoxton), LTD, and claims to carry on business for the company via its own platform, financewiseint.com. The two websites are almost identical. In accordance with section 37 (4) of the German Banking Act (Kreditwesengesetz – KWG), BaFin would like to make clear that F.W International (Finance Wise International) does not have authorisation under the KWG to conduct banking business or provide financial services. The company is not supervised by BaFin. The provider claims to have branches in Germany (Berlin), Cyprus, Australia and the United Kingdom. It also claims to be registered with the Cyprus Securities and Exchange Commission; however, this registration refers to a company called IC Global Markets Ltd. and the registration cannot be verified.

Five associations have come together to form a new alliance – the UK Forum for Digital Currencies (UK FDC) – which will celebrate innovation and collaboration across the payments industry. Members include the City of London Corporation, Digital Pound Foundation, The Payments Association, TheCityUK and UK Finance. The aim of the alliance is to develop better policies, practice and regulation around digital currencies.

The digital asset markets continued to decline in December, however, volatility waned compared to the month prior. Bitcoin closed the year down 64.2%, its second worse annual performance in its 13-year history. December also saw significantly lower volumes than the months prior, with Bitcoin recording a 42.6% month-on-month decline in USDT volumes across centralised exchanges.
