Further to the announcement made at 7:00 am today (Friday), Hong Kong Exchanges and Clearing Limited (HKEX) announced that the morning trading sessions of the securities (including Stock Connect Northbound trading) and derivatives markets have been cancelled due to a Black Rainstorm Warning remaining in force and the announcement of Extreme Conditions by the Hong Kong Government.

Dissenting Statement Of CFTC Commissioner Summer K. Mersinger Regarding Enforcement Actions Against: 1) Opyn, Inc.; 2) Deridex, Inc.; And 3) ZeroEx, Inc.

The Commission has been presented with a package of three proposed, and unusual, enforcement actions. Although each case presents different facts, they have been lumped together for Commission consideration and vote (presumably for messaging purposes) as “DeFi” cases. That is, each case involves a decentralized finance (“DeFi”) protocol – a collection of smart contracts residing on a blockchain that replicates certain functions of the traditional financial system in a decentralized manner.

CFTC Issues Orders Against Operators Of Three DeFi Protocols For Offering Illegal Digital Asset Derivatives Trading

The Commodity Futures Trading Commission today continued its enforcement focus in the digital asset decentralized finance (DeFi) space, by issuing orders simultaneously filing and settling charges against Opyn, Inc., a Delaware-registered company based in California; ZeroEx, Inc., a Delaware company based in California; and Deridex, Inc., a Delaware company based in North Carolina.

Linus Financial Agrees To Settle SEC Charges Of Unregistered Offer And Sale Of Securities - SEC Declines To Impose Civil Penalties Because Of Firm’s Cooperation And Prompt Remediation

The Securities and Exchange Commission today announced settled charges against Linus Financial, Inc. for failing to register the offers and sales of its retail crypto lending product, the Linus Interest Accounts. The SEC determined not to impose civil penalties against Linus Financial because of the Nashville-based company’s cooperation and prompt remedial actions.

Statement Of CFTC Commissioner Kristin N. Johnson Regarding CFTC Resolving Charges Against Three Decentralized Finance Companies: The Need For Oversight

Yesterday, the Commodity Futures Trading Commission (CFTC) announced the entry of charges against operators of three decentralized finance (DeFi) protocols. For the first time, the CFTC charged a DeFi operator—Opyn, Inc. and Deridex, Inc—with failing to register as a swap execution facility (SEF) or designated contract market (DCM). The CFTC also charged these businesses with failure to register as a futures commission merchant (FCM) and failure to adopt know your customer (KYC) procedures and a customer identification program (CIP) as required by the Bank Secrecy Act. Opyn, Deridex, and a third company, ZeroEx, Inc., were also charged with illegally offering leveraged and margined retail commodity transactions in digital assets.

CFTC Charges Texas Firm And Head Trader With Spoofing And Engaging In A Manipulative And Deceptive Scheme And Violating A Prior CFTC Order

The Commodity Futures Trading Commission today filed a civil complaint in the U.S. District Court for the Northern District of Illinois against Logista Advisors LLC and Andrew Serotta, charging them with spoofing, engaging in a manipulative and deceptive scheme, failing to supervise, and for violating a prior CFTC order.
