The Exchange intends to cease operating New York Block Exchange (“NYBX”), effective February 28, 2013, and as such, proposes to contemporaneously delete the text of Rule 1600, which governs NYBX’s functionality.

While I concur in the terms of the settlement in this matter with regard to the findings of violations and the non-monetary components of the settlement order, I respectfully dissent as to the amount of the civil monetary penalty (CMP).  A CMP of $200,000 is wholly inadequate as a penalty for the wash sale activity that Mr. Martin A. Lorenzen directed and oversaw while acting as a manager at the Gelber Group LLC.

US Treasury To Designate Eurex Exchange As “Qualified Board Or Exchange - Designation Enables U.S. Persons To Receive 60/40 Tax Treatment

The international derivatives marketplace Eurex Exchange announced today that the U.S. Treasury will publish a revenue ruling in which it designates Eurex as a “Qualified Board or Exchange” for purposes of section 1256 of the U.S. Internal Revenue code. This ruling, effective for all contracts entered on or after 1 March 2013, means that U.S. persons that trade on Eurex Exchange may receive ‘60/40 tax treatment’ in the same way when trading at other U.S. futures exchanges.

This is an important step forward for Europe's businesses, regions, scientists, NGOs and all beneficiaries of EU funds. I am obviously disappointed that the European Council settled for such reduced amounts for future EU budgets at the same time as those same Member States keep entrusting the EU with more and more competencies, but a deal between Member States is better than no deal at all for all those across Europe who rely on EU funds.
