Associations Support A Designated Reporter Regime In The UK

On September 16, 2022, ISDA submitted a response to the Financial Conduct Authority’s (FCA) consultation on improving equity secondary markets (CP22/12). Although the focus of the consultation was primarily on equity markets, the FCA was also consulting on introducing a designated reporter regime for all asset classes, including derivatives. ISDA endorses the responses by the Association for Financial Markets in Europe and UK Finance, and all associations support the creation of this regime at asset-class level. The new regime is designed to allocate the obligation to report trades to the public to sell-side firms.

Today Refinitiv commences publication of forward-looking term rate versions of its ARRC recommended fallback rates - USD IBOR Cash Fallbacks. This follows the Alternative Reference Rates Committee’s (ARRC) March 2021 announcement that it had selected Refinitiv to publish its recommended fallback rates for cash products, and Refinitiv’s July 2022 announcement that it intends to launch the new USD IBOR Cash Fallbacks settings in September 2022.

On 7 September 2022, BaFin prohibited Unity Investment Group, which claims to be based in Staverdenstraat 14, 2573 DD’s-Gravenhage, the Netherlands, from offering Photon Energy N.V.’s “6.50 % Green EUR Bond 2021/2027” bond (ISIN: DE000A3KWKY4, securities identification number (WKN): A3KWKY4) to the public. The prohibition was imposed due to a violation of Article 3(1) of the EU Prospectus Regulation. Unity Investment Group is therefore not authorised to offer this security to the public in Germany.
