SEC Charges OTC Link LLC With Failing To File Suspicious Activity Reports

The Securities and Exchange Commission today announced charges against OTC Link LLC, a New York-based broker-dealer, for failing to file numerous reports of suspicious financial transactions, known as Suspicious Activity Reports (SARs), for a period of more than three years. OTC Link agreed to pay $1.19 million to settle the charges.

CFTC Orders Texas Company To Pay $100,000 For Failing To Register As An Introducing Broker

The Commodity Futures Trading Commission today issued an order simultaneously filing and settling charges against Cost Management Solutions, LLC (CMS), a Texas corporation. The order finds the respondent failed to register as an Introducing Broker (IB) and requires CMS to pay a $100,000 civil monetary penalty. The CFTC also orders CMS to cease and desist from further violating the CEA, as charged.

Recently, the Financial Accounting Standards Board (“FASB” or the “Board”) completed a comprehensive update to its Conceptual Framework for Financial Reporting (“Conceptual Framework”). Now that it has finalized this significant project, it is important that the Board actively consider the objectives and fundamentals in the updated Conceptual Framework throughout all of its standard-setting activities, to guide the Board in developing improved accounting principles to enhance the accuracy and effectiveness of financial reporting and the protection of investors in the public interest.

SEC Charges NovaTech And Its Principals And Promoters With $650 Million Crypto Fraud - Multi-Level Marketing Company Promoted Scheme To Defraud More Than 200,000 Investors Worldwide

The Securities and Exchange Commission today announced charges against Cynthia and Eddy Petion, along with their company, NovaTech Ltd., for operating a fraudulent scheme that raised more than $650 million in crypto assets from more than 200,000 investors worldwide, including many in the Haitian-American community. The SEC also charged Martin Zizi, Dapilinu Dunbar, James Corbett, Corrie Sampson, John Garofano, and Marsha Hadley for their roles in promoting NovaTech to investors.

The EBA Responds To The European Commission’s Delegated Act Postponing The Application Of The Market Risk Framework In The EU

Following the European Commission’s adoption of a Delegated Act postponing the application of the revised market risk framework in the EU, the so-called Fundamental Review of the Trading Book (FRTB), the European Banking Authority (EBA) today publishes a no-action letter on the boundary between the banking book and the trading book and shares its considerations on technical questions and issues arising from the postponement.

FESE Response To The ESMA Call For Evidence On The Review Of The UCITS Eligible Assets Directive

FESE welcomes the call for evidence and considers that a more flexible approach in the UCITS Eligible Assets Directive could promote market liquidity and the attractiveness of EU markets. For example, the “5/10/40 Rule” for investments in transferable securities and money market instruments can be detrimental to issuers and investors and we suggest a review and potential adjustment of this rule to a more flexible “20/40 Rule”.
