U.S. Seeks To Recover Over $73 Million In Proceeds Traceable To Bank Fraud To Conceal The Involvement Of Jho Taek Low

The Department of Justice announced today the filing of a civil forfeiture action in the U.S. District Court for the District of Columbia seeking to forfeit and recover more than $73 million in funds associated with an international conspiracy to defraud U.S. financial institutions and to launder funds controlled by Jho Taek Low, also known as “Jho Low,” an individual who is the subject of an indictment filed in the Eastern District of New York, alleging that Low and others conspired to launder billions of dollars embezzled from 1Malaysia Development Berhad (1MDB), Malaysia’s investment development fund, and pay hundreds of millions of dollars in bribes to foreign officials, among other things.

B3 Announces The 14th ISE – Corporate Sustainability Index Portfolio

B3 announced today the release of the fourteenth Corporate Sustainability Index (ISE) portfolio, effective from January 7, 2019 to January 3, 2020. The new ISE portfolio, whose technical partner since its inception is the Center for Sustainability Studies at the Fundação Getúlio Vargas (FGVces), comprises 35 stocks from 30 companies. The companies are drawn from 13 industry sectors and together account for a  market capitalization of BRL1.73 trillion, 48.66% of the combined figure for all the  companies whose stocks are traded on B3, based on the November 27, 2018 closing (in 2017, it accounted for 41.47%)

SEC Adopts FAIR Act Rules Promoting Research Reports On Investment Funds

The Securities and Exchange Commission today adopted rules and amendments designed to promote research on mutual funds, exchange‑traded funds, registered closed-end funds, business development companies, and similar covered investment funds. These changes reduce obstacles to providing research on investment funds by harmonizing the treatment of such research with research on other public companies. The Commission took this action in furtherance of the mandate in the Fair Access to Investment Research Act of 2017 (FAIR Act).

Statement Of CFTC Chairman J. Christopher Giancarlo On The Proposal To Amend Annual Privacy Notice Requirements To Implement The FAST Act

This proposal will revise Commission regulation 160.5’s privacy notice requirements to implement the Fixing America’s Surface Transportation (FAST) Act’s December 2015 statutory amendment to the Gramm-Leach-Bliley Act (GLBA).  In proposing to implement what is now almost a three-year-old statutory requirement, this proposal is a good demonstration of this Commission’s commitment to supporting good governance.

• Roiled by Brexit tensions, global trade uncertainty, and sharp declines in commodity prices, European equities slipped in November.  The S&P Europe 350® fell 0.8% on the month and is now down 4.6% on the year. 
• The S&P United Kingdom declined 1.4% as markets anxiously awaited the outcome of Brexit negotiations.  Market uncertainty drove Pound price volatility to its highest levels since the Brexit referendum.  Though the EU and Prime Minister Theresa May have struck a tentative deal for the U.K's exit from the EU, it will still need to pass Parliamentary muster. 
• European sector results were mixed.  A sharp decline in oil prices weighed down the Energy sector, leading to a 6% decline on the month.  Broadly, commodity baskets declined, leading to a 6% decline for the Materials sector as well. It was not all doom and gloom, however; the Communication Services sector was the shining star, gaining 7.2%.

CFTC Approves A Proposed Rule To Provide Exception To Annual Privacy Notice Requirement

The Commodity Futures Trading Commission (CFTC) today approved a proposed rule to revise a CFTC regulation that requires certain futures commission merchants, retail foreign exchange dealers, commodity trading advisors, commodity pool operators, introducing brokers, major swap participants, and swap dealers to provide annual privacy notices to customers. Under the proposed rule these annual privacy notices would no longer be required where certain conditions are satisfied.
