I am concerned by reports of retail investors being unable to exercise options they purchased on Silicon Valley Bank and Signature Bank stock. I am hopeful that broker-dealers and clearing agencies will make efforts to assist retail investors in exercising their options if the investors wish to do so, including by exploring possible cash settlements. In addition, I hope that FINRA and my colleagues at the SEC will move forward with efforts to establish a comprehensive regulatory framework around complex products, including options, which are risky and can expose an investor to sudden and severe losses.

Introduction – The Impact of Other Auditors in a Global Audit

The increasing integration of world economies and the resultant globalization of multinational public companies has led to increased use of, and more significant roles for, accounting firms and individual accountants other than the lead auditor (“other auditors”) on many issuer audit engagements. In 2021, for example, 26 percent of all issuer audit engagements and 57 percent of large accelerated filer audits involved the use of other auditors by the lead auditor. In some cases, engagements include the use of other auditors that may not even be registered with the Public Company Accounting Oversight Board (“PCAOB”) and that work in countries with different business cultures and languages from those of the lead auditor.

The cyber-related incident at ION prevented the submission of timely and accurate data to the CFTC last month. As a result, the weekly CFTC Commitments of Traders (CoT) report has been delayed. Today, staff will not issue the Commitments of Traders report as data for this week will need to be reviewed and validated.

Pursuant to Section 5c(c)(1) of the Commodity Exchange Act, as amended (“Act”), and Section 40.6(d) of the regulations promulgated by the Commodity Futures Trading Commission (the “Commission”) under the Act (the “Regulations”), North American Derivatives Exchange, Inc. (“Nadex”, the “Exchange”) hereby provides notice that due to increased or decreased volatility, as the case may be, in the underlying markets upon which the Nadex contracts are based, Nadex made changes to the strike widths of various contracts during the week of March 13, 2023 as indicated in the Weekly Notice.

Big tech credit has been growing rapidly in recent years. As they are less reliant on traditional collateral, big tech lenders can lend to borrowers that have been unserved or underserved by traditional financial institutions. As a source of disruption, big techs represent a "brave new world" for monetary policymakers, requiring them to re-evaluate the effectiveness of monetary policy transmission through these new lenders.
