The purists in the audience will not allow me to use the terms Islamic bonds and sukuk interchangeably. Some may even say that it is because there is little that is Islamic about bonds that we have seen the birth and phenomenal growth of sukuk! Others would argue equating the two has stifled innovation and prevented the wider use of indigenous participatory Shariah principles and concepts. It is not my intention to expand on that debate but I will be using the term sukuk.

ESMA Begins AIFMD Co-Operation Discussions With Non-EU Supervisors

ESMA announces today that it will begin discussions with non-EU supervisors of entities subject to the requirements of the Alternative Investment Fund Managers Directive (AIFMD) about supervisory co-operation issues. This follows agreement by ESMA’s Board of Supervisors to follow a common policy in relation to the co-operation arrangements under AIFMD, which should be in place between EU and non-EU securities supervisors by July 2013.

SEC Charges Former Morgan Stanley Executive With FCPA Violations And Investment Adviser Fraud

The Securities and Exchange Commission today charged a former executive at Morgan Stanley with violating the Foreign Corrupt Practices Act (FCPA) as well as securities laws for investment advisers by secretly acquiring millions of dollars worth of real estate investments for himself and an influential Chinese official who in turn steered business to Morgan Stanley’s funds.
