  • Euronext Wins Court Case VS. TOM And Binckbank

    Euronext welcomes the verdict by the District Court in the Hague, the Netherlands, in the proceedings on the merits against TOM and BinckBank, which upheld Euronext’s claim that TOM had breached its various intellectual property rights by trademark infringement, database infringement, breach of contract and publishing misleading information and activities for investors. The Court has awarded the majority of Euronext’s claims, after Euronext was already vindicated in the summary proceedings. The Court found that TOM’s and BinckBank’s claims that their systems offer the best price are “misleading statements” and should therefore be removed from the websites of both companies. Moreover TOM and BinckBank both have to place an announcement regarding misleading advertisement of their Smart Order Router on the websites of Alex, BinckBank and TOM.

  • ESMA To Delay Publishing Opinion And Advice Under Article 67(1) Of The AIFMD

    The European Securities and Markets Authority (ESMA) is still in the process of finalising its opinion and advice to the European Commission, Council and Parliament on Article 67 (1) of the Alternative Investment Fund Managers Directive (AIFMD) and intends to publish them during the week beginning 28 July rather than on 22 July as previously expected.

  • TOM: Court Rules That Euronext Should Accept Exchange Competition

    Today, the District Court (Court) of The Hague forced Euronext to accept competition between exchanges, rejecting the demand of Euronext to block competition between exchanges. This is clear from the judgment of the Court in proceedings filed by Euronext against competitor TOM. The Court states that TOM is allowed to continue trading AEX options and may continue using ticker symbols for single stock equity options that are similar to the ticker symbols of Euronext. Furthermore, the court states that TOM needs to have its own product-introduction policy; in anticipation of this, TOM has already introduced its own policy as of 13 June 2014, including the creation of new strikes and maturities. The court has not prevented TOM from using the term Best Execution for marketing purposes, but has found that no guarantees can be made by using the term ‘always best price’.
