SEC Joins Department Of Justice In Supporting Constitutionality Of PCAOB

Chairman Christopher Cox of the U.S. Securities and Exchange Commission announced today, in connection with a pending lawsuit challenging the constitutionality of the Public Company Accounting Oversight Board, that the Commission joins with the U.S. Department of Justice in supporting the constitutionality of the PCAOB. A brief for the United States setting forth the government's arguments in support of the PCAOB's constitutionality was submitted today in the U.S. District Court for the District of Columbia in the case of Free Enterprise Fund v. The Public Company Accounting Oversight Board. Counsel on the brief include the Commission's General Counsel.
