The New York Police Department supported NYSE's opposition to plaintiff's application for preliminary injunctive relief, noting that the checkpoint challenged by plaintiff, Wall Street Parking Garage Corp., is essential to the security of NYSE and neighboring persons and buildings and stating the necessity for NYPD to staff such checkpoints with its own personnel if the Court enjoined NYSE from doing so. NYSE believes plaintiff failed to meet its burden of establishing its right to preliminary injunctive relief and intends to seek immediate relief from the appellate court. In the interim, NYSE continues to take all steps necessary to ensure the continued safety of NYSE, the people who work at NYSE, and of its neighbors.
