NYSE Statement Re: Court Decision About Security, March 12, 2004

In issuing a preliminary injunction enjoining NYSE from maintaining security blockades and conducting vehicle searches at various intersections near the NYSE, New York Supreme Court Justice Walter B. Tolub ordered that the injunction will not become effective until five business days after plaintiff's service of Notice of Entry of the Order on the Exchange, thereby providing the opportunity for NYSE to seek to stay the injunction while appealing it. Accordingly, the security perimeter and security measures in place around the NYSE will remain unchanged.

The New York Police Department supported NYSE's opposition to plaintiff's application for preliminary injunctive relief, noting that the checkpoint challenged by plaintiff, Wall Street Parking Garage Corp., is essential to the security of NYSE and neighboring persons and buildings and stating the necessity for NYPD to staff such checkpoints with its own personnel if the Court enjoined NYSE from doing so. NYSE believes plaintiff failed to meet its burden of establishing its right to preliminary injunctive relief and intends to seek immediate relief from the appellate court. In the interim, NYSE continues to take all steps necessary to ensure the continued safety of NYSE, the people who work at NYSE, and of its neighbors.
