Hearing Adjourned In Criminal Prosecution For Noncompliance With Hong Kong Securities And Futures Commission Notices In Market Manipulation Investigations

The Eastern Magistrates’ Court today adjourned the hearing to 17 September 2026 on the criminal prosecution brought by the Securities and Futures Commission (SFC) against Mr Oliver Chow Pak Wah for his alleged failures to comply with the notices issued under section 183 of the Securities and Futures Ordinance (SFO) in relation to two ongoing market manipulation investigations (Notes 1 to 3).

At today’s hearing, Chow pleaded not guilty to three charges, alleging that, without reasonable excuse, he failed to produce records and documents and attend interviews required by notices issued by the SFC on 24 July 2024, 9 August 2024 and 25 October 2024, respectively.  

Chow was brought before the Court after being apprehended pursuant to arrest warrants issued by the Magistrate, following his failures to attend two earlier court hearings on 23 October 2025 and 4 December 2025 (Note 4).

He was granted bail by the Court subject to the following conditions: (i) cash bail of HK$15,000; (ii) he shall not leave Hong Kong and shall surrender his travel documents; (iii) he shall reside at the home address provided and inform the Police prior to any change of residence and (iv) he shall report to police station three times a week.

Notes:

  1. The SFC commenced the investigations under section 182 of the SFO.
  2. Under section 183(1) of the SFO, the person under investigation or a person whom the investigator has reasonable cause to believe has in his possession any record or document which contains, or which is likely to contain, information relevant to an investigation, or whom the investigator has reasonable cause to believe otherwise has such information in his possession, shall, amongst others, (a) produce to the investigator, within the time and at the place the investigator reasonably requires in writing, any record or document specified by the investigator which is, or may be, relevant to the investigation and which is in his possession; or (b) attend before the investigator at the time and place the investigator reasonably requires in writing, and answer any question relating to the matters under investigation that the investigator may raise with him.
  3. The prosecution against Chow was bought under sections 184(1)(a) and 184(1)(c) of the SFO.
  4. The SFC applied the arrest warrants at the hearing on 4 December 2025 after Chow failed to attend the court proceedings.
