Borsa İstanbul Pursues The Court Suit Regarding The Attempted Occupation Of Borsa İstanbul On July 15th

The first hearing of the court suit regarding the attempted occupation of Borsa İstanbul on July 15th during the coup d’etat attempt was held in Silivri on November 7-9, 2017.

The hearing was held in the building across Silivri Penitentiary Institution Campus by Istanbul 30th High Criminal Court. In addition to Borsa İstanbul, Turkish Prime Ministry, Istanbul Metropolitan Municipality, martyrs’ families and survivors participated in the hearing as intervenor-plaintiff.

Two persons; one policeman and one civilian, were martyred and 46 were injured during the attempted occupation of Borsa İstanbul. The hearing lasted for three days.

Borsa İstanbul staff participated in the hearing as spectators. The next hearings will be held on March 8 and 9, 2018.

From the Indictment

 

The 270-page indictment, prepared by prosecutor Orhan Aydın from Istanbul Terror and Organized Crimes Bureau about 15 suspects including 2 majors (one escape suspect), refers  to martyred policeman Mehmet Şevket Uzun and Fatih Satır as “murdered”, 46 injured persons as “victims” and 7 citizens and Borsa İstanbul, as “complainant”. 

The indictment describes the attempted occupation of Borsa İstanbul located in Istinye, Sarıyer at around 23:50 during the coup d’etat attempt on July 15, by the suspects driving two military vehicles. The indictment envisages life sentence in solitary confinement, with no possibility of parole for ex-major Ahmet Baykal, non-commissioned officer Seyit Ali Şahin and escape suspect ex-major Murat Çelik on grounds of “attempting to terminate the constitutional order, the Grand National Assembly of Turkey (TBMM), and the government of the Republic of Turkey by exerting violence and tyranny” (aggravated by three times) and on grounds of “intentionally murdering 2 persons for the purpose of covering up a crime” (aggravated by two times).

The indictment further envisages imprisonment of the suspects for a total period varying between 907 years 6 months to one thousand 412 years. The breakdown is 1 to 9 years for “damaging goods” for three times; 2 to 8 years for “damaging publicly owned goods” for twice; 7.5 to 15 years for “being a member of an armed terrorist organization”, 897 years to 380 years for “attempting to intentionally murder 46 persons for the purpose of covering up for a crime“.

The indictment envisages life sentence in solitary confinement with no possibility of parole (aggravated by five times) and imprisonment for a term varying from 6 months to 412 years for imprisoned suspects military students and privates Emre Sözer, Fatih Yılmaz, Hasan Yürek, Muhammed Atasoy, Muhammed Furkan Kenger, Murat Fırat, Muzaffer Bardakçı, Orhan Baz, Ramazan Korkmaz, Serhat Kalyüncü, Veysel Çınarbaş and Zafer Öztan. The prosecutor demands imprisonment for the accused on grounds of intentionally and willingly helping the armed terrorist organization, without being a member of it.
