BATS Exchange Application Available For Public Comment - SEC Publishes Document On Its Public Website

BATS Trading Inc., operator of the BATS ECN, received notification from the Securities and Exchange Commission that the BATS exchange application has been published and is available for public comment.

The exchange document is available at: http://www.sec.gov/rules/other.shtml.

“While BATS has been preparing for the transformation from an ECN to a National Securities Exchange, we also stand committed to continuing the trend of efficiency and innovation our subscribers have benefited from throughout our initial phase as an ECN,” Chief Executive Joe Ratterman said. “We are looking forward to receiving comments from our subscribers, business partners, competitors, and the public, and to a full vetting of all aspects of our application."

Eric Swanson, general counsel at BATS, added “Initiation of the public comment period represents yet another significant and exciting step in our effort to become a National Securities Exchange, and we look forward to continuing to work with the SEC and the industry as we move forward with our application.”

Mr. Swanson served at the SEC from 1996?2006, rising to the title of Assistant Director in the Office of Compliance Inspections and Examinations’ market oversight unit in Washington.
