Tokyo Stock Exchange: Partial Revision Made To The Format For Reporting Short Selling Positions

Due to partial revisions, etc, made to the Enforcement Ordinance for the Financial Instruments and Exchange Act for tightening short selling regulations, any persons holding a certain number of short selling positions are required to report said positions and other related information to the exchanges via securities companies, begininning on November 7, 2008.

Method to Provide Outstanding Short Selling Positions and Other Related Information as Well as Method of the TSE to Publish Such Information.

The TSE has provided a sample format(*i) for the aforementioned reports up until November 5, 2008. However, some market particpants, etc. have expressed the opinion that they would like to include other information in the report, such as the reason they are submitting the report and the conditions related to how they meet the criteria, including information on fluctuations in the outstanding short position ratio. After taking market participants' opinions into consideration, the TSE has revised the sample format ("Report on Outstanding Short Positions") by adding a "Note" column where you can describe this information(ii).

(*i)The sample format is just an example. Based on the laws and regulations, you are not required to necessarily use the same format.

(*ii)The sample format for the name and address,"Report on Name, Address, etc. Pertaining to Outstanding Short Positions Information,"which the TSE published on November 5, 2000 remains the same.
