The mandate of the current ACER Board of Appeal (BoA) comes to an end next week after five years in operation. A new BoA will take over immediately after.
ACER would like to warmly thank all the outgoing Members for having set up and maintained a sound procedural system in full respect of the basic rights to a fair procedure by the parties concerned. At the end of its term the BoA has issued a press statement accessible here.
ACER BoA is part of the Agency but is independent from its administrative and regulatory structure. Any natural or legal person, including national regulatory authorities can lodge an appeal against a decision taken by ACER where the Agency has actual decision-making powers (individual decisions). The decisions of the BoA may themselves be subject to appeal before the Court of Justice of the European Communities.
