NZX Discipline replaces the market surveillance panel, the Complaints Committee and the Disciplinary Committee. Its function is to determine whether there has been a breach of the rules that apply to the markets NZX operates and the participants in those markets.
NZX Discipline members, who are drawn from the legal profession, listed issuers, market participants, NZX and the public, are as follows:
Legal: Tim Williams, Derek Johnston, Victoria Heine, Laurie Mayne, Simon McArley and Michael Webb.
Listed issuers: Don Trow, Patsy Reddy, John Loughlin, Peter Wilson and Roger Armstrong.
Market participants: Campbell Stuart, Tim Preston, William Stevens and Michael Jeffs.
NZX: Bill Malthus, Martin Rea and Geoff Brown.
Members of the public: Paul Ridley-Smith, Philip Meyer, Nic Short, Falc Clouston, Steven Moir and Peter Hays.
NZX head of Regulatory and Public Policy Elaine Campbell said NZX is extremely happy with the depth and quality of the group that forms NZX Discipline, which encompasses expertise in law, finance and the securities markets.
“This group incorporates the independent experience, knowledge and breadth of expertise that is necessary for NZX Discipline to increase confidence in the markets that NZX operates,” she said. “We were overwhelmed with the quantity and quality of applications, and as a result we're extremely confident in the appointees' abilities to discharge the functions conferred on them under the NZX Discipline Rules.”
Aside from determining breaches of rules, NZX Discipline also determines referrals made by applicants for waivers and rulings from decisions made by NZX Regulation.
