Given the currently disclosed information the NYSE will continue to monitor the Company's continued listing status and its financial condition in light of these ongoing developments. The NYSE will continue trading in the Company's securities at this time as the Company currently complies with the NYSE's quantitative continued listing standards. These standards require total market capitalization of not less than $50 million over a 30 trading day period and stockholders' equity of not less than $50 million; total market capitalization of not less than $15 million over a 30 trading day period; and a minimum share price of $1 over a 30 trading day period.
The NYSE, however, is not limited by these quantitative standards. Rather, it may make an appraisal of, and determine on a individual basis, the suitability for continued listing of an issue in light of all pertinent facts whenever it deems such action appropriate, even though a security meets or fails to meet any enumerated criteria.
The NYSE noted that it may, at any time, suspend a security if it believes continued dealings in the security on the NYSE are not advisable.
