NYBOT Receives ROIE Status In U.K.

The New York Board of Trade (NYBOT), a wholly-owned subsidiary of IntercontinentalExchange (NYSE: ICE), announced today that the United Kingdom’s Financial Services Authority (FSA) has made a recognition order designating NYBOT as a “Recognised Overseas Investment Exchange” (ROIE). This recognition was made under Section 292 of the Financial Services and Markets Act 2000 following approval from HM Treasury. Recognition will allow NYBOT to expand access to electronic trading in the U.K and increase the scope of its sales and marketing activities.

The ROIE status will take effect immediately. In February, NYBOT began offering its electronic markets for soft commodity futures on the ICE trading platform. On June 15, NYBOT will add its U.S. Dollar Index ® and Russell 1000 ® Indexes to the ICE platform.

NYBOT, which is regulated by the Commodity Futures Trading Commission (CFTC) in the United States, submitted an application for recognition as an ROIE in December 2006, pending its acquisition by IntercontinentalExchange in January 2007. The application was reviewed by the FSA to ensure, among other things, that: (1) investors in the U.K. are afforded protections equivalent to those applicable when trading on U.K. investment exchanges; (2) the applicant is willing to cooperate by sharing information with U.K. regulators; and (3) adequate arrangements exist for information sharing between the CFTC and FSA. In addition, NYBOT’s application was found by the UK’s Office of Fair Trading (OFT) not to have any adverse effect on competition.
