Madrid Stock Exchange 2013 Ombudsman Report - Rise In Requests For Information Filed By Issuers, Which Become The 3rd Main Type Of ApplicanT

Date 12/03/2014

  • The number of claims remains stable, at 20, while the absence of contentiousness continues
  • Complaints outside the Ombudsman’s remit rise to 36% of the total

“The chapter with the highest number of requests for information continues to be that of corporate relevant facts, while the verification of orders executed by intermediaries represents the bulk of the queries relating to stock exchange transactions”, said  Carlos Fernández, Madrid Stock Exchange Ombudsman, during the presentation of its 2013 Report.

As regards the informative function, the retaill investor is the main applicant for  information, representing 78% of the total, which has remained stable in recent years. In this chapter the most important new feature is the significant increase in the information requested by the issuers through the issuance of certificates of trading, and which continue demanding very specific information. In 2012 these queries ranked at the bottom of the table, at 1%, while in 2013 they climbed to the third place, representing 5%.

"Among the complaints, in 2013 non-contentious claims increased to account for 68% of all filed in 2013”, stated the Ombudsman.

As for the investor protection function, the number of claims filed in 2013 reached 20, only two less than in 2012, reinforcing the trends and figures recorded in previous reports, with the exception of the procedures chapter, which falls outside the Ombudsman’s remit. These have risen 36% of all the complaints. Of all the written files handled, the educational and informative function of the Ombudsman remains much higher than that of meditation, although in 2013 the differences shown by the contentious queries vis a vis the resolutions adopted were slightly reduced.
