Hong Kong's Securities And Futures Commission: Court Sets Trial Dates For China Metal Recycling (Holdings) Limited Case

The court has set down the dates for the trial of the China Metal Recycling (Holdings) Limited (China Metal Recycling) case (Note 1).

The trial will be heard in the Court of First Instance from 2 to 17 February, and from 24 February to 6 March 2015.

On 10 March 2014, the Hon Mr Justice Harris gave further directions on procedural and other matters in the Securities and Futures Commission’s (SFC) proceedings seeking orders to wind up China Metal Recycling and adjourned the hearing of the petition to 25 August 2014 for further directions.

The SFC’s investigation is continuing.

The Securities and Futures Commission presented a petition to the Court of First Instance on 26 July 2013 to wind up China Metal Recycling under section 212 of the Securities and Futures Ordinance and obtained an order on an ex parte basis on the same day to appoint provisional liquidators for China Metal Recycling. On 2 August 2013, the court granted an order for the continuation of the appointment of the provisional liquidators.
