CLARITY Act Failure: A Setback for US Digital Assets, But Not The End Of The Road - James Butterfill, Head Of Research, CoinShares

The US digital asset industry has suffered a blow following the failure to advance the CLARITY Act, though experts suggest the legislation has been blocked rather than buried.
James Butterfill, Head of Research at CoinShares, described the development as "incrementally negative rather than a major shock," noting that the remaining obstacles are increasingly political rather than technical, despite substantial efforts to find bipartisan compromise.

"CLARITY would provide something the industry has been seeking for years: a coherent federal market structure and much clearer regulatory boundaries," Butterfill said. "That uncertainty will now persist for longer, potentially slowing investment and innovation in the US."

A procedural route back to another vote remains open, though the tightening political calendar poses a significant challenge. Butterfill was keen to stress that whilst the economic case for regulatory clarity remains unchanged, yesterday's vote suggests the politics may take considerably longer to resolve.

The news comes as the US Federal Reserve is expected to raise interest rates, compounding the pressure on digital assets. However, Butterfill pointed to rising US government bond yields as a continued hedge against fiscal and monetary policy uncertainty.
