Further to the CESR Call for Evidence (Ref. CESR/04-022) published on 20 January 2004 regarding the provisional Mandate received from the European Commission on the proposed revised Financial Instruments Markets Directive (ISD2), CESR publishes today a Consultative Concept Paper. The concept paper covers the provisional Mandate given to CESR by the EU Commission related to transaction reporting (Art. 25 ISD2), the competent authorities’ obligation to cooperate (Art. 56) and the exchange of information between competent authorities (Art. 58). The paper complements the Call for Evidence and aims at collecting comments from all interested parties at an early stage before the draft of a consultative paper, due to be approved by CESR in June, is drawn up. It sets out the general approach and the main orientations in addressing the Mandate, and requests input from all interested parties on the areas covered, in particular by asking a number of open questions. All interested parties are invited to comment on this paper by 12 April 2004. Comments can be posted directly on CESR’s new Website (www.cesr-eu.org) under the section “Consultations”.
