CBOE Chairman And CEO William Brodsky Receives Indexing Lifetime Achievement Award At Super Bowl Of Indexing Conference
William J. Brodsky, Chairman and CEO of the Chicago Board Options Exchange (CBOE), has received the William F. Sharpe Indexing Lifetime Achievement Award for his career-long support of index products as risk-management tools. The award was presented earlier this month at the Super Bowl of Indexing Conference in Phoenix, Arizona.

SEC Charges Ernst & Young And Six Partners For Roles In Accounting Violations At Bally Total Fitness - Ernst & Young To Pay $8.5 Million To Settle Charges - Former Bally CFO And Controller Also Charged
The Securities and Exchange Commission today charged Ernst & Young LLP and six of its current and former partners, including three who are members of the firm's national office, for their roles relating to an accounting fraud at Bally Total Fitness Holding Corporation. The SEC finds that E&Y knew or should have known about Bally's fraudulent financial accounting and disclosures.

CFTC Sanctions MF Global Inc. $10 Million For Significant Supervision Violations Between 2003 And 2008 - CFTC Charges Relate To Risk Supervision Failures In Four Separate Instances
The U.S. Commodity Futures Trading Commission (CFTC) today announced the filing and simultaneous settlement of charges against MF Global Inc., a registered futures commission merchant, and its predecessor corporation, Man Financial Inc. (collectively, “MF Global”), relating to risk supervision failures in four separate instances between 2003 and 2008.

SEC: Fee Rate Advisory #4 For Fiscal Year 2010
Yesterday President Obama signed H.R. 3288, the appropriations bill that includes funding for the Securities and Exchange Commission. Accordingly, effective Dec. 21, 2009, the Section 6(b) fee rate applicable to the registration of securities, the Section 13(e) fee rate applicable to the repurchase of securities, and the Section 14(g) fee rate applicable to proxy solicitations and statements in corporate control transactions will increase to $71.30 per million dollars. Leadership Changes At Xtrakter
Xtrakter, the fixed income specialist, announced a series of changes to its leadership team which will take effect from January, 2010. Yannic Weber will become the new Chief Executive Officer (CEO) for Xtrakter, replacing Kevin Milne, who will step down from the role to pursue interests outside the Euroclear group.

Next, we will consider a recommendation to adopt rules to enhance the custody controls that apply to investment advisers. Our goal when this process began was to strengthen the protections provided to investors who turn over their assets to investment advisers. I am pleased that today’s rules, if adopted, will achieve that goal.
